These Terms of Service constitute a legally binding agreement made between you and Coastline Charging LLC ("we," "us," or "our"), concerning your access to and use of the Coastline Charging website as well as any other media form, media channel, mobile website, or mobile application related or connected thereto (collectively, the "Service").
By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with these Terms of Service, then you are expressly prohibited from using the Service and you must discontinue use immediately.
Changes to Terms of Service
We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Service at any time and for any reason. You are responsible for regularly reviewing these Terms of Service to stay informed of updates.
Intellectual Property Rights
All content, features, and functionality on the Service, including but not limited to all information, text, displays, images, video, and audio, are owned by Coastline Charging, its licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property or proprietary rights laws.
Restrictions on Use
You agree not to:
Use the Service in any way that violates any applicable federal, state, local, or international law or regulation.
Use the Service to engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm Coastline Charging or users of the Service or expose them to liability.
Reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as expressly permitted by these Terms of Service.
Free Charge Offer Introduction
At Coastline Charging, we're dedicated to enhancing your electric vehicle experience. To showcase our commitment, we're excited to present our Mobile EV Charge promotional offering (available seasonally):
Free Charge Offer
Eligibility: When active, this promotion is exclusively available to first-time users of the Coastline Charging service who reside within our designated service areas. Each eligible user or household can avail of a one-time free charge of 14 kWh.
Service Area: Service Area: Our primary regions for this mobile charge promotion include Orange County, California. Requests from users outside of these areas will be considered, but please be aware that our ability to provide service in such areas isn't guaranteed.
Redemption: To take advantage of this offer, users must register on our website (if the promotion is active) and provide a valid email address. Upon successful registration, an automated email will be dispatched detailing the specifics of the free mobile charge offer. To redeem, users are expected to actively communicate with our team within a 72-hour window from opting in to schedule their free mobile charge. If not scheduled within this timeframe, the offer becomes void.
Limitations: The free mobile EV charge offer cannot be exchanged for cash, transferred to another user, or used in conjunction with other promotions or discounts.
Modification or Termination: Coastline Charging retains the right to alter, pause, or conclude the free mobile charge offer at its discretion, with or without prior notice. Any modifications to this offer will be announced on our website or through our standard communication channels.
No Guarantee: While we aim to provide prompt and reliable service, the free mobile charge offer is presented on an "as-is" basis. Coastline Charging doesn't promise immediate availability or an uninterrupted charging session during the promotion.
Disclaimer of Warranties
You understand and agree that your use of the Service is at your own risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, either express or implied.
Limitation of Liability
To the maximum extent permitted by law, in no event shall Coastline Charging, its affiliates, licensors, service providers, employees, agents, officers, or directors be liable for any direct, indirect, punitive, incidental, special, consequential, or exemplary damages arising out of or in connection with your access to or use of the Service.
Indemnification
You agree to defend, indemnify, and hold harmless Coastline Charging, its affiliates, licensors, service providers, contractors, employees, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to the Service or your violation of these Terms of Service.
Governing Law and Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of the State of California without regard to its conflict of law provisions.
Charging Memberships
Introduction
Welcome to Coastline Charging ("Coastline", "we", "our", "us"). By subscribing to our emergency charging service, you agree to comply with and be bound by the following terms and conditions. Please review them carefully.
1. Subscription Terms
1.1. The subscription to Coastline Charging's Mobile EV Charging Service can be on a month-to-month or annual basis.
1.2. The subscription fee is charged either monthly or annually and will be automatically renewed unless canceled as per the cancellation policy in section 4 of the Terms and Conditions.
1.3. There is a 7-day activation period for the membership to become active after subscription. This period helps prevent users from subscribing to a membership when they are already in need of charging services and may be attempting to leverage the membership discount in a way that would undermine Coastline Charging's mission. Early activation can be requested and time after successful subscription, but we reserve the right to deny the request.
2. Services Provided
2.1. Coastline Charging provides Mobile Electric Vehicle Charging Services to subscribed users.
2.2. The scope of services includes, but is not limited to, electric vehicle battery charging and related support services.
3. Payment Terms
3.1. Subscription fees are billed monthly or annually on the date of subscription commencement.
3.2. Coastline Charging accepts all major credit cards.
4. Cancellation Policy
4.1. You may cancel your subscription at any time by contacting: [email protected]
4.2. For monthly subscriptions, any prepaid subscription fees for the current month will be refunded on a pro-rata basis, pending review of your cancellation.
4.3. For annual subscriptions, any prepaid subscription fees for the remaining months will be refunded on a pro-rata basis, pending review of your cancellation.
4.4. Refunds will be processed within 14 business days after the review of the cancellation request.
5. User Responsibilities
5.1. Users are responsible for ensuring their devices/vehicles are compatible with Coastline’s Charging’s service. If unsure, please contact us using the contact information provided below.
5.2. Users must provide accurate and up-to-date information during the subscription process.
6. Limitation of Liability
6.1. Coastline Charging is not liable for any damages or losses resulting from the use of our services, except where such liability cannot be excluded by law.
6.2. Our liability to you for any claim arising out of or in connection with our services is limited to the amount you paid us in the month prior to the event giving rise to the claim.
7. Dispute Resolution
7.1. Any and all legal actions that are beyond small claims court will be resolved through arbitration.
7.2. Each Arbitrator that is presented to the parties will have to be mutually agreed upon prior to hiring the Arbitrator. If an agreement cannot be made within 60 days, then the matter will be subjected to the Rules of Arbitration as dictated by JAMS. Please refer to www.jamsadr.com for more information.
7.3. The parties will pay their own legal fees, and each party will pay half of the case management and arbitrator's fees.
8. Changes to Terms of Service
8.1. Coastline Charging reserves the right to modify these terms and conditions at any time.
8.2. Any changes will be communicated to you via email or through our website.
9. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
